General Terms of Sale

Before the strictly legal section: these terms are written to be readable. If anything is unclear, write to us — we'll reformulate together.

Article 1 — Scope

These General Terms of Sale (hereafter “Terms”) apply to all sales of products made through infuse.earth (hereafter “the Site”) between:

  • I Infuse SARL, whose details appear in Article 2 (hereafter “the Seller” or “INFUSE”), on the one hand;
  • any adult natural person or legal entity placing an order on the Site (hereafter “the Customer”), on the other.

Any order placed on the Site implies the Customer's full and entire acceptance of these Terms. The Customer acknowledges having read the Terms and having accepted them by ticking the dedicated checkbox before validating the order.

INFUSE reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of the order. The last update date appears at the bottom of this page.

Article 3 — Products

INFUSE sells medicinal, aromatic and ceremonial plants, incenses and resins, elixirs, and accessories related to their preparation and use.

Products are described and presented with the greatest possible accuracy on the Site. Photographs, illustrations and descriptions have no contractual value and may slightly differ from the actual product (natural variation of plants across harvests, packaging changes).

Information about traditional use, composition, sourcing, preparation and storage is provided for informational and cultural purposes. It does not constitute medical or therapeutic advice. See Article 14.

INFUSE reserves the right to amend its product range at any time, without prior notice. Pending orders are fulfilled under the terms in force at the time of their validation.

Article 4 — Prices

Prices are stated in euros (€), VAT included for sales to private consumers residing in the European Union.

Prices account for the VAT applicable on the order date:

  • 5.5% on food plants (herbal teas, plants for food infusion)
  • 20% on alcoholic elixirs, incenses, accessories and non-food products
  • Any change in VAT rate may be reflected in product prices.

Shipping fees are not included in the displayed product price. They are calculated and shown to the Customer before final order validation, based on weight and destination.

For shipments outside the European Union, customs duties and any local taxes are the sole responsibility of the Customer and are collected by the carrier on delivery.

INFUSE reserves the right to amend prices at any time, it being understood that products are invoiced based on rates in force at the time of order validation.

Article 5 — Orders

5.1 Order process

  1. Select products and add them to the cart.
  2. Review the cart and proceed to checkout.
  3. Provide billing and shipping details.
  4. Choose a shipping method.
  5. Choose a payment method.
  6. Read and accept these Terms (mandatory checkbox).
  7. Finalise the order by completing payment.

5.2 Confirmation

After payment validation, the Customer receives a confirmation email recapping the entire order. This email constitutes INFUSE's acceptance of the order and formalises the sales contract.

5.3 Order refusal

INFUSE reserves the right to refuse any order for a legitimate reason (existing dispute, suspicion of fraud, abnormal order, out-of-stock, undeliverable address). In case of refusal, the Customer is informed by email and fully refunded within 14 days.

Article 6 — Payment

6.1 Payment methods

Payment is made in full at the time of the order. Accepted methods: bank cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and any other method offered by our Stripe provider at the time of the order.

6.2 Security

Transactions are processed by Stripe Inc. and Stripe Payments Europe Ltd, a PCI-DSS Level 1 certified provider. No card data transits through INFUSE's servers. The 3D Secure protocol is enabled by default in line with the PSD2 directive.

6.3 Validation and debit

The Customer's account is debited upon order validation. If payment is refused, the order is cancelled and the Customer is informed by email.

6.4 Invoicing

An electronic invoice is issued for each paid order and sent by email to the Customer. INFUSE retains invoices for 10 years, in line with Article L123-22 of the French Commercial Code.

Article 7 — Delivery

7.1 Delivery zones

INFUSE ships to mainland France, Corsica, every EU member State, as well as the following countries: United Kingdom, Switzerland, Norway, United States, Canada. For any other destination, write to gestion@infuse.earth.

7.2 Carriers

Shipments are prepared via our logistics platform Sendcloud, which orchestrates the partner carriers (Colissimo, Mondial Relay, Chronopost, DPD, UPS, Royal Mail, USPS, depending on the destination chosen at checkout).

7.3 Lead times

Shipments leave every Tuesday and every Friday, before 3pm (Paris time). An order placed before Friday 2pm ships on Friday (3pm); an order placed between Friday 2pm and Tuesday 2pm ships on Tuesday. Lead times are given for guidance. INFUSE cannot be held responsible for delays caused by the carrier, force majeure, or an error in the shipping address provided by the Customer.

7.4 Fees

Shipping fees are calculated at checkout based on weight and destination.

7.5 Receipt

On receipt, the Customer is invited to check the parcel's condition. In case of apparent damage, lodge reservations with the carrier immediately and contact gestion@infuse.earth within 48h, attaching photos.

Article 8 — Right of withdrawal

8.1 Period

Under Article L221-18 of the French Consumer Code, private Customers have a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

8.2 Procedure

To exercise this right, the Customer must notify their decision by email to gestion@infuse.earth or by using the model form below, before the 14-day period expires.

8.3 Return of the product

The Customer must return the products in their original packaging, sealed and intact, within 14 days of communicating their decision to withdraw, to the address provided by INFUSE.

8.4 Return fees

Return fees are at the Customer's expense, except in case of error or non-conformity on INFUSE's side.

8.5 Refund

INFUSE refunds the full amount paid (products + standard shipping fees) at the latest 14 days after receiving the compliant return, through the original payment method.

8.6 Exceptions

Under Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • goods unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons (opened pouches, unsealed incenses, opened elixirs);
  • goods personalised to the Customer's specifications;
  • goods likely to deteriorate quickly.

Article 9 — Legal warranties

9.1 Legal warranty of conformity

Under Articles L217-3 et seq. of the French Consumer Code, INFUSE is required to deliver goods conforming to the contract. The Customer has a period of 2 years from delivery of the goods to act under the warranty of conformity.

9.2 Legal warranty against hidden defects

Independently, the Customer may invoke the warranty against hidden defects (Article 1641 of the French Civil Code). Action must be brought within 2 years from discovery of the defect (Article 1648).

9.3 How to invoke

To invoke either of these warranties, contact gestion@infuse.earth explaining the defect and attaching supporting documents. INFUSE replies as soon as we can.

Article 10 — Liability

INFUSE commits to doing everything possible to ensure the quality of the products and the proper performance of orders. Nevertheless, INFUSE's liability cannot be engaged:

  • in case of non-compliance by the Customer with the legislation of the country of delivery;
  • in case of misuse of the products by the Customer (incorrect preparation, inappropriate dosage, ignored contraindication);
  • in case of non-performance due to force majeure, the act of a third party, or the act of the Customer;
  • for any indirect loss resulting from the purchase.

Plants sold by INFUSE are not medicines. They are in no way a substitute for medical advice, diagnosis or treatment prescribed by a healthcare professional.

Article 11 — Personal data

Processing of the Customer's personal data is governed by our privacy policy, in line with the GDPR (EU Regulation 2016/679) and the French Data Protection Act of 6 January 1978 (as amended).

Article 12 — Mediation and complaints

12.1 Customer service

For any complaint, contact INFUSE customer service at gestion@infuse.earth. We reply as soon as we can.

12.2 European ODR platform

Under regulation (EU) no. 524/2013, the Customer may use the European online dispute resolution platform.

Article 13 — Applicable law and jurisdiction

These Terms are governed by French law.

In case of dispute, after seeking an amicable solution, French courts shall have sole jurisdiction. Under Article R631-3 of the French Consumer Code, the consumer may, at their choice, refer the case to the court of the place where they were residing at the time of conclusion of the contract or at the time of the harmful event.

Article 14 — Special notes about plants

14.1 Traditional and cultural use

Plants sold by INFUSE are offered as medicinal, aromatic, ceremonial or wellbeing plants, from the perspective of traditional use rooted in diverse ethnobotanies. Descriptions, historical notes, testimonies and cultural contexts on the Site belong to ethnobotanical and cultural documentation. They constitute neither medical advice, nor a prescription, nor a promise of therapeutic effect.

14.2 No medical claim

INFUSE makes no therapeutic claim about the products it sells. The products are not medicines in the sense of the French Public Health Code.

14.3 User responsibility

It is up to the Customer to ensure that products suit their personal situation, to consult a healthcare professional in case of doubt, and to follow the preparation methods described on product pages.

14.4 Exclusions and sensitive audiences

Unless explicitly stated otherwise, products are not intended for minors under 18, for pregnant or breastfeeding women without prior medical advice, or for people on medication likely to interact without prior medical advice.

Some products are subject to specific legal restrictions in certain countries: it is up to the Customer to check the compliance of the order with the legislation of their country of residence and delivery.
